Welcome to Docelligent / Hgear.ai (“we,” “us,” or “our”). By accessing or using our website, products, or services (collectively, the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully before using the Platform.

If you do not agree with these Terms, you must not use our website or services.

Use of Services

  • You must be at least 18 years old to use our Platform.
  • You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Intellectual Property

  • All content, trademarks, and materials on this Platform — including but not limited to logos, text, software, and graphics — are the intellectual property of Formative Solutions or its licensors.
  • You may not reproduce, distribute, modify, or exploit any part of the Platform without prior written consent from Formative Solutions.

Acceptable Use

You agree not to:

  • Upload, share, or transmit any content that is unlawful, harmful, or infringes upon the rights of others.
  • Attempt to gain unauthorized access to the Platform, systems, or data.
  • Use the Platform to store, process, or transmit sensitive personal health information (PHI) unless explicitly authorized under a separate signed Business Associate Agreement (BAA) or equivalent agreement.

Account and Subscription

  • Free and paid plans may have different access levels, limits, and features.
  • We reserve the right to modify, suspend, or terminate your account in cases of misuse or violation of these Terms.
  • All subscription payments are non-refundable, unless otherwise stated in a signed agreement or required by law.

Data & Content Ownership

  • You retain full ownership of all documents, data, or content you upload or share through the Platform.
  • By using the Platform, you grant us a limited, non-exclusive license to process, store, and transmit your data for operational purposes only.
  • We do not claim ownership of your content, nor do we use it for any unrelated or commercial purpose.

Service Availability

While we strive for continuous uptime, we do not guarantee that the Platform will be uninterrupted, secure, or error-free. Scheduled maintenance, updates, or third-party dependencies may result in temporary downtime.

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability in any event shall not exceed the total amount paid (if any) by you for the services during the preceding 12 months.

Modifications to Terms

We may update these Terms periodically. Updates will be reflected with a new effective date. Your continued use of the Platform following such updates constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.
Any disputes or claims arising out of or relating to these Terms, or the use of the Platform, shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
